Can NRIs Invest in Indian Mutual Funds?

Oct 16
4 min read

Yes, NRIs are permitted to invest in Indian mutual funds under the Foreign Exchange Management Act. However, there are specific procedural requirements that must be met before you begin. You will need either a Non-Resident External (NRE) account or a Non-Resident Ordinary (NRO) account with an Indian bank. These accounts serve as the gateway through which your investments flow and through which returns are eventually received.

It is also worth noting that certain countries, such as the United States and Canada, carry additional compliance requirements due to bilateral tax treaties and regulations. NRIs from these countries may find that fewer mutual fund houses accept their applications. Working with an AMFI registered mutual fund distributor helps you identify which funds are available to you and guides you through the documentation process correctly.

Understanding NRI Mutual Fund Tax Rules

Taxation is one of the most important considerations for NRIs. The NRI mutual fund tax rules in India are broadly similar to those applicable to resident investors, with a few key distinctions. Here is an overview of how gains are taxed:

Equity Mutual Funds

  • Short-Term Capital Gains (STCG): If you redeem your equity fund units within 12 months of purchase, gains are taxed at a flat 20%.

  • Long-Term Capital Gains (LTCG): Gains arising after 12 months are taxed at 12.5% on the amount above ₹1.25 lakh in a financial year. Indexation is not available.

Debt Mutual Funds

  • Units bought on or after 1 April 2023: Gains are added to your total income and taxed at the applicable slab rate, irrespective of how long you hold the units. Indexation is not available.

  • Units bought earlier: Gains on units held beyond 24 months are taxed at 12.5% without indexation, while gains within 24 months are taxed at the slab rate.

Tax Deducted at Source (TDS)

An important distinction for NRIs is that TDS is deducted at source before you receive your redemption proceeds. The mutual fund house deducts the applicable tax and remits it to the government on your behalf. This differs from the process for resident Indians, who self-report and pay. As a result, you may need to file a return in India to claim any excess TDS deducted, depending on your total income and applicable Double Taxation Avoidance Agreement (DTAA) benefits.

Repatriation of Mutual Fund Investments

One of the most practical questions NRIs ask is: Can I send my money back abroad after redeeming my mutual fund units? The answer depends largely on the type of bank account used to make the original investment.

Account Type

Repatriation Allowed

Conditions

NRE Account

Yes, fully repatriable

Both principal and gains can be sent abroad freely

NRO Account

Limited repatriation

Up to USD 1 million per financial year, subject to tax compliance

For those who prioritise the flexibility to move their returns abroad without restriction, investing through an NRE account is the recommended route. The repatriation of mutual fund investments made through an NRE account is straightforward once TDS obligations have been met.

If your funds are routed through an NRO account, you will need to obtain a certificate from a chartered accountant confirming that applicable taxes have been paid before remitting funds abroad. This is a standard process but does involve additional paperwork.

Documentation You Will Need

To complete your KYC and begin investing, you will generally require:

  • A valid passport copy

  • Proof of overseas address

  • PAN card (mandatory for all mutual fund investments in India)

  • NRE or NRO bank account details

  • Recent passport-sized photographs

  • FATCA and KYC declaration forms

The exact documents may vary slightly depending on the fund house and your country of residence. An AMFI registered mutual fund distributor can provide you with a personalised checklist based on your specific situation.
